Ord. No. 20-009 - Outdoor Seating

Township of Cranford - Ordinance No. 20-009 - An Ordinance to Amend the Code of the Township of Cranford, Part III: Health Legislation, Chapter 255 Land Development, to Temporarily Delegate Certain Planning Board Duties to a Code Review Committee

The intent of Ordinance No. 20-009 is to mitigate, to the greatest extent practicable, the negative impacts of social distancing requirements on eateries and bars located in the Township. The ordinance addresses these hardships by temporarily granting the power to approve a Site Plan Waiver to a Code Review Committee for the creation or expansion of outdoor seating.

The ordinance has a sunset date of December 31, 2020, unless extended by ordinance by the Township Committee.

Applicants are required to meet numerous requirements for the creation or expansion of outdoor seating facilities:

  1. The property which hosts the applicants business was not subject to a previous site plan approval with conditions of approval that would be affected by the proposed improvements;
  2. The proposed is compliant with all requirements and standards as defined in Article V - Zoning of Chapter 255 - Land Development and would not otherwise be required to seek relief from the Zoning Board of Adjustment;
  3. The proposed is compliant with all requirements and standards as defined in Chapter 225 - Flood Damage Prevension;
  4. The proposed is compliant with all applicable health code requirements;
  5. The proposed is compliant with all applicable fire and construction code requirements.

The Code Review Committee, consisting of the Zoning Officer, Construction Official, Township Engineer, Health Official, FIre Official and the Mayor or his/her designee, is directed to apply the same standards  for review and approval typically designated to the Planning Board and to ensure that the standards and requirements established in Chapter 255 - Land Development are applied. 

All applications are to be posted on the Township Website for public review and interested parties are welcome to join the Code Review Committee meeting to offer their comments and concerns.
